Job Description
Overview:
The Fiduciary Advisor is part of the Fiduciary Administration Centers of Excellence and provides guidance and oversight with respect to new fiduciary business acceptance or fiduciary account closings. This is an individual contributor role within the first line of defense and reports to the Director of Trust and Estate Services.
Key Accountabilities and Responsibilities:
  • Provide fiduciary administration guidance as part of the Fiduciary Administration Center of Excellence.
  • Engage internal partners (Director of Trust and Estate Services/Tax Services/Privately Held Investments/Legal/Wealth Strategies/Client Service) as part of the oversight process for new fiduciary business.
  • Perform trust pre-acceptance review, trust acceptance sign-off and prepare trust digest for account opening, review terminations/closings and assist with preparation of receipt and releases, etc.
  • Review non-judicial settlement agreements, decanting agreements, trust modifications, and other documentation related to the fiduciary business.
  • Review fiduciary appointments and related documents; refer to external counsel as necessary and manage related work product.
  • Provide advice and consult with client teams on questions regarding trust administration and interpretation of trust language and refer them to internal Legal Counsel, if necessary
  • Provide advice on discretionary distributions and approvals within prescribed limits and established authority.
  • Provide advice to client facing advisors on potential trust opportunities (trust review, administration questions).
  • Participate as an active member of several internal regulatory management committees as required.
  • Develop fiduciary administration policies and procedures as directed.
Knowledge and Skills:
  • Attorney with 7+ years of previous experience working in a trust department or trust company.
  • Strong knowledge of trust and tax regulations on both a state and federal level; ability to capably review trust documents and summarize key provisions.
  • Excellent writing skills and the ability to effectively draft communications to advisors, regulators and external counsel, as needed.
  • Advanced analytical skills and attention to detail required for the review of complex, legal documents.
  • Excellent interpersonal skills to effectively interact with all levels of management and staff as well as external contacts.
  • Strong organizational, time management and multi-tasking skills as well as detail-oriented.
  • Excellent relationship building and stakeholder management skills

  • Speaking up if witnessing behaviors that drive poor or unfair outcomes for clients, team members or other stakeholders
  • Escalating matters that can result in adverse market practices and outcomes, thereby negatively impacting CIBC’s reputation as a leading financial institution
